Back by popular demand for the third year in a row, this session will include an engaging discussion about the latest legal issues impacting the testing industry by a panel of four attorneys, each from a different law firm, all of whom have extensive experience representing testing organizations. In the first 30 minutes of this session, panelists will provide updates in areas of law that are experiencing significant changes, current litigation, or ongoing uncertainty. Topics include the latest developments in copyright rules for secure tests, privacy regulations throughout the US, Europe, UK, China and elsewhere in the world, the Americans with Disabilities Act and legal risks associated with the use of systems and platforms that incorporate artificial intelligence (AI), including generative AI platforms to develop and modify test content, AI used in test delivery and monitoring, and other AI-driven assessment applications. The remaining 20 minutes of the session will be dedicated exclusively to questions from the audience. Panelists will share actionable strategies that will better enable programs and service providers to adapt to emergent technology and changing laws.
